Jurimex lawyers carried out a complex analysis of the legal relations among the companies managed by a large international holding company engaged in manufacturing and selling the products by using a well-known brand, as well as the existing contracts regulated by the UK laws to check whether or not they can be implemented in Ukraine.
The lawyers prepared the expert opinion describing the practical mechanism of the trademark rights transfer and use, the franchising-related issues within Ukrainian legal background. In addition they provided their recommendations as to the contractual provisions which would best regulate the legal relations among the residents of Ukraine, the UK, the Netherlands and a number of other countries. This was supported by the drafts of the proposed contracts. The recommendations also covered optimising product and cash flows, tax payments and customs fees.
